Terms and Conditions

Effective Date: July 26, 2026 · These Terms constitute a legally binding agreement between you and ExamKracker.

    Please read these Terms carefully before using ExamKracker. By registering an account, logging in (including via Google Sign-In), using the quiz engine, accessing paid membership features, or simply browsing the public areas of the platform, you confirm that you accept these Terms and agree to be bound by them. If you do not agree with any part of these Terms, you must discontinue use of ExamKracker immediately.
  

1. Definitions

"Platform" means the ExamKracker web application, including all pages, APIs, quiz content, analytics dashboards, and associated services.
"User" means any individual who accesses or uses ExamKracker, including unregistered guest visitors.
"Member" means a User who has purchased an active paid subscription to ExamKracker.
"Content" means all questions, answer explanations, study notes, previous-year question PDFs, textual content, images, structured data, and source code made available on the Platform.
"User-Generated Content" (UGC): Any material (reviews, comments, feedback text) submitted by Users to the Platform through the Contact, reviews, or feedback features.
"Subscription" means the paid premium membership tier that unlocks unlimited quiz attempts and full analytics dashboard access.

2. Eligibility & Account Registration

You must be at least 13 years of age to use ExamKracker. Users aged 13–17 require consent from a parent or legal guardian.
When registering an account, you agree to provide accurate, current, and complete contact information.
You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account.
ExamKracker reserves the right to disable or suspend accounts that violate these Terms, are suspected of fraudulent or abusive usage, or share credentials with unauthorized parties.
Accounts registered using automated methods, disposable emails, or for the purpose of bypassing daily attempt limits are subject to immediate termination.

3. Guest / Public Website Mode

Where the Site Administrator has enabled Public Website Mode, visitors may browse syllabi, courses, topics, subtopic landing pages, study notes, previous year question viewers, and even begin quiz attempts without logging in. These privileges do not change the terms of this Agreement — guest usage still constitutes acceptance of these Terms. Guest users who later create an account will have their in-progress quiz data associated with their new profile at the point of login/sign-up.

4. Acceptable Use

You agree not to:

Use ExamKracker to violate any applicable local, state, national, or international law or regulation.
Reverse-engineer, decompile, scrape, crawl (by automated robots or manually at volume), copy, or redistribute any portion of the question bank, analytics engine, or platform source code without our prior written consent.
Attempt to bypass quiz session controls, daily attempt throttles, membership paywalls, level-gating, difficulty progression, or session-based answer protection logic.
Upload, post, or transmit any User-Generated Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, hateful, racially, ethnically, or otherwise objectionable.
Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity.
Introduce any virus, trojan, worm, logic bomb, or other malicious or technologically harmful material into the Platform or its underlying infrastructure.
Interfere with, disrupt, or attack the availability of the Platform via denial-of-service tactics, credential stuffing, or similar abuse.

5. Intellectual Property & Content Ownership

5.1 Our Content

All Content published or made available on ExamKracker (including without limitation the proprietary question bank, study notes, PYQ papers curated by our team, platform UI design, logos, the ExamKracker brand name, and underlying software) is the exclusive property of ExamKracker or our duly licensed content partners. This Content is protected under the Copyright Act, 1957 (India) and international copyright treaties.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Content for your own personal, non-commercial, educational purposes only. You may not reproduce, distribute, publicly display, create derivative works from, republish, sell, license, or commercially exploit any part of the Content without our explicit written permission.

5.2 User-Generated Content (UGC)

By submitting reviews, comments, or feedback text to ExamKracker, you grant us a perpetual, worldwide, royalty-free, non-exclusive license to host, reproduce, moderate, display, remove, and republish that content (in whole or in part) for the purpose of operating and improving the Platform. You represent and warrant that you own or have all necessary rights to any UGC you submit.

We reserve the right, at our sole discretion, to remove, reject, or refuse to publish any UGC for any reason, including (without limitation) content that breaches these Terms, contains inaccuracies, violates third-party rights, or is otherwise unsuitable for the community.

6. Paid Subscriptions & Memberships

6.1 Description of Membership Benefits

Paid Memberships unlock (i) unlimited quiz attempts per day (bypassing free-tier daily attempt caps), (ii) full historical analytics on the dashboard, (iii) access to all 5 difficulty levels regardless of progression status, and (iv) suppression of non-essential promotional messaging. The exact benefits of a Subscription may change over time at ExamKracker's discretion; material changes will be communicated to active Members in advance.

6.2 Pricing, Billing & Payment

All Subscription fees are displayed in Indian Rupees (INR) and include applicable taxes unless stated otherwise.
Payments are securely processed by our PCI-DSS compliant payment gateway, Razorpay. You agree to provide current, complete, and accurate billing information.
A Subscription becomes active once the payment gateway confirms successful receipt of funds and ExamKracker has marked your UserProfile as an active member.
Subscription durations, renewal dates, and membership expiry dates are displayed in the Payments / History section of the user account and are definitive.

6.3 Auto-Renewal

Unless explicitly stated otherwise at the point of purchase, Subscriptions on ExamKracker are one-time, non-recurring and do not auto-renew. You will receive explicit notification before expiry and may manually extend your membership by purchasing again.

7. Refund & Cancellation Policy

Subject to the Consumer Protection Act, 2019 (India) and our separate Refund Policy (incorporated by reference into these Terms):

Membership fees are generally non-refundable once access to premium features has been granted.
Refund requests made within 48 hours of purchase, where the Member has not consumed more than 3% of the paid benefit (e.g., fewer than 10 quiz sessions) are evaluated on a case-by-case basis and may be eligible for a full or partial refund at our sole discretion.
No refunds will be granted in cases of account suspension or termination due to violation of these Terms.
If we discontinue a core paid feature for reasons within our control (and not due to a Terms breach), we will, at our option, either (a) issue a pro-rata refund of the unused portion of your Subscription, or (b) provide equivalent compensatory access.

8. Disclaimers of Warranties

EXAMKRACKER AND ITS AFFILIATES, LICENSORS, AND PARTNERS MAKE NO REPRESENTATIONS OR WARRANTIES WHATSOEVER, EXPRESS OR IMPLIED, REGARDING THE PLATFORM, ITS CONTENT, ACCURACY OF QUESTIONS OR EXPLANATIONS, OR FITNESS FOR A PARTICULAR EXAM OR PURPOSE. THE PLATFORM AND ALL CONTENT ARE DELIVERED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EXAMKRACKER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, QUIET ENJOYMENT, QUALITY, OR ACCURACY.

We do not guarantee that the Platform will: (a) be uninterrupted, error-free, or free from virus or other harmful components; (b) meet your individual requirements or expectations; or (c) ensure any specific exam outcome, score improvement, or level of performance. Study results are your responsibility and depend on many factors beyond our control.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EXAMKRACKER, ITS DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFIT, DATA, GOODWILL, OR ANTICIPATED SAVINGS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, OR FROM ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR USER CONTENT OR TRANSMISSIONS.

NOTWITHSTANDING THE FOREGOING, EXAMKRACKER'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE PLATFORM, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES ACTUALLY PAID BY YOU TO EXAMKRACKER DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms is intended to exclude or limit our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable Indian law.

10. Indemnification

You agree to fully indemnify, defend, and hold harmless ExamKracker, its affiliates, officers, directors, employees, agents, and content partners from and against any and all claims, damages, costs, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) your User-Generated Content; (c) your violation of any law, regulation, or third-party right (including intellectual property rights); or (d) any activity conducted through your account by yourself or another person.

11. Termination

Either party may terminate the agreement created by these Terms: (a) by you, by deleting your account via written request to the Grievance Officer listed in our Privacy Policy; or (b) by us, for any reason, upon providing 15 days' prior notice via the email on your account. We may also suspend or terminate access immediately and without notice where (in our reasonable opinion) you have materially breached these Terms (including, but not limited to, unauthorized sharing of account credentials, scraping Content, or abuse of the quiz engine). On termination, your license to use the Platform ends immediately; Sections 5 (IP), 8 (Warranties), 9 (Liability), 10 (Indemnification), and 14 (General) shall survive termination indefinitely.

12. Dispute Resolution & Governing Law

These Terms are governed by and construed in accordance with the laws of India, without reference to its conflict-of-laws rules.
Any dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of India. For convenience and in line with the Information Technology Act, 2000, the venue for any such proceedings shall be deemed to be the location of the registered operations of ExamKracker as notified from time to time.
Prior to commencing formal proceedings, you agree to first attempt resolution informally by contacting our Grievance Officer via the Contact page and allowing 30 days for good-faith negotiation.

13. Modifications to the Terms

ExamKracker may revise these Terms at any time by posting an updated version on this page with a revised Effective Date. Material changes will be accompanied by a reasonable notice period (not less than 7 days) via platform notification or email. Your continued use of ExamKracker following the effective date of the revised Terms constitutes your binding acceptance of the changes.

14. General Provisions

Severability: If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect.
Waiver: No waiver of any provision shall be deemed a further or continuing waiver of such provision or any other provision.
Assignment: You may not assign or delegate any rights or obligations under these Terms without our prior written consent. We may freely assign these Terms in connection with a merger, acquisition, or sale of assets.
Entire Agreement: Together with the Privacy Policy, Cookie Policy, Disclaimer, and Refund Policy, these Terms constitute the entire agreement between you and ExamKracker and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written, on the same subject matter.
No Third-Party Beneficiaries: These Terms do not and shall not confer any benefit or right of enforcement upon any person who is not a party to them.
